Terms of Use

These conditions govern each visit, search, and use of Pocahontas County Criminal History. Continuing to use the resource means accepting every term below. Anyone who does not agree must stop using it.

NO FCRA USE. This privately run resource is not connected to a government agency, private investigation firm, or consumer reporting agency. Neither it nor an advertising partner offers a service for credit, employment, insurance, tenant, or other decisions regulated by the Fair Credit Reporting Act. Its purpose is to help readers locate Pocahontas County and Iowa criminal-record sources.

1. What This Website Is

This is a private reference site with no government affiliation. It does not store official criminal records, order official checks, retrieve files, or submit paperwork for a user.

Its content identifies custodians such as the Pocahontas County Sheriff, Iowa District Court, Iowa DCI repository, and Iowa Sex Offender Registry. Some pages also connect readers to independently operated search tools.

2. Rules for Using This Site

Use is allowed only on these conditions:

  • Do not interfere with the site's operation or another visitor's access
  • Do not deploy scrapers, bots, or other automated collection tools
  • Do not attempt unauthorized access to any system or account
  • Do not use information to stalk, threaten, or harass a person
  • Do not use content for hiring, housing, credit, or insurance decisions
  • Do not violate federal, Iowa, or local law

3. No Harassment, Stalking, or Discrimination

Information found here or through a linked tool must not be used to stalk, threaten, intimidate, harass, or discriminate. Iowa Sex Offender Registry data exists for public safety awareness. Iowa Code chapter 692A controls the registry, and misuse against a registrant may carry legal consequences. Vigilante action and discriminatory use are forbidden.

4. We Are Not a Consumer Reporting Agency

We are not a consumer reporting agency under the FCRA and do not create consumer reports, credit reports, or official background checks. Information from this resource or a linked tool may not be used to:

  • Set insurance eligibility or premiums
  • Evaluate creditworthiness
  • Screen a renter or housing applicant
  • Make an employment decision
  • Carry out another FCRA-regulated purpose

A legally permissible official check must be obtained through Iowa DCI or an appropriate FCRA-compliant provider.

5. No Legal Advice

The material is general information, not legal advice. Only a licensed Iowa attorney can apply rules about a charge, conviction, warrant, or expungement to a particular situation.

6. No Warranties

All material and services are provided "as is." No promise is made that:

  • A partner's search results will be complete or correct
  • Every page will be free from defects or security weaknesses
  • Service will remain uninterrupted
  • Every item will always be current, complete, or accurate

Charges, dispositions, custody, sealing, and expungement status can change. Gaps or delays are possible. Only the originating court, sheriff, DCI, or other custodian can make an official statement about its record.

7. Third-Party Services and Links

Links lead to county offices, Iowa agencies, courts, legal resources, and independent search services. The destination controls its own content, availability, privacy practices, and charges. Review its terms before use.

8. Intellectual Property

Text, graphics, logos, and code belong to Pocahontas County Criminal History or its content partners. Copying, distributing, adapting, or building upon that material requires prior written permission.

9. Limits on Our Liability

To the greatest extent allowed by law, we are not liable for loss arising from use of this resource, its information, or a linked service.

10. Indemnification

You agree to defend and hold us harmless from claims or demands caused by your use or violation of these terms, including related legal costs.

11. Governing Law

Iowa law governs these terms. Any dispute tied to use of the resource must be brought in a court located in Iowa.

12. Changes to These Terms

Revised terms may be posted at any time and take effect when published on this page.

13. Cutting Off Access

Access may be limited or ended at any time, with or without advance notice.

14. Severability

If one provision is held invalid or unenforceable, the other provisions remain effective. The affected language is modified only as needed to make it enforceable.
